Marking bug as "Won't Fix" since Octave can do very little about gnuplot's internal positioning algorithm.

And I confirm the same behavior on the default branch with gnuplot. But as you say, this is probably a limitation of gnuplot that has to be accepted as is.

The last instruction should put the legend outside of the plot, but in fact it
does nothing.

If works, however, if you first set the location to 'northeastoutside' rather
than 'northeast'.

Was there sample code?  It didn't show up in the bug report.  Also, note that version 4.0.3 of Octave is deprecated.  You might try the latest stable version which is 4.2.1.  Finally, legend positioning is done by gnuplot, not Octave.  That's one of the reasons the built-in OpenGL graphics toolkits are preferred because Octave has more control over how the output appears.
