Fixed in this changeset (http://hg.savannah.gnu.org/hgweb/octave/rev/69cd5ebe5fb5).  To access the fix you will need to download the development sources from the Mercurial archive and build from scratch.  Instructions for downloading are available here (http://www.gnu.org/software/octave/download.html)

If a graphics object handle is empty, trying to access a property displays a warning that might be confusing:

octave> a=[]
a = [](0x0)
octave> get(a,'x')
warning: implicit conversion from matrix to real vector
ans = [](0x0)
octave> get([],'x')
warning: implicit conversion from null_matrix to real vector
ans = [](0x0)

Silently returning an empty matrix seems enough.
