3Com hold patents on something called 'parallel tasking' which means that
the code in our 3com card drivers that uses this would be violating patents
if it was used with a clone of the card (there are afaik no clones of these
cards in actuality).

The flash adaption layer is subject to patent grants which allow us only
to use it with PCMCIA devices or on M-Systems devices.

USB has patents involved in it and grants made by people for the standard that
only allow use for USB. It is far from the only 'standard interface' document
where people have made grants solely for use in implementing the standard.

In general these patents all cover hardware and how you interface to it. The
M-Systems one is more unusual in that its a very broad patent and covers
almost every way you can use flash devices as a file system (almost because
as of 2.4test the folks at Axis technologies believe they have a patent avoiding
logging file system for flash media)
