This is in progress @licensing.

Besides brackets, Brett doesn't like the "including the right to grant others rights to distribute at any tier". Indeed, if this right is explicitly granted, it sounds like the license doesn't give other freedom to tiers (eg you have the rights but the version to redistribute to others don't have the same rights, preventing releasing modified versions) - or something like that, INAL.

I also precised that the license could not be changed at first glance, because you don't own the copyright, and because the copyright holder is currently unreachable.

I wrote to Eric almost two weeks ago. However,
I am yet to hear anything from him. He works
for M$ now and I am not sure whether he would
even be bothered about GPL compatibility issue!!

If so, then only option I see is to get the final
opinion about GPL compatibility of the license
from Savannah legal team. I am really interested
in getting their opinion even if it takes some time.
Do I need to re-submit the project once again,
given you have closed the project?

I agree that this is probably wording details, but unfortunatly that would matter in court.


So I would suggest using one of the existing licenses compatible with the GNU GPL, verbatim. The license sometimes refered to as "MIT license" (Expat and X11 at http://www.gnu.org/licenses/license-list.html) would be nice, and of course the current W3C's Software Notice and License would fit too (note that none of the licenses versions mentioned in the W3C  page match Eric's).

I just had a re-look at the license of Brill's tagger and

So to recap, as I understand your application is a derived and GPL'd version of Eric Brill's piece of software, which is under unclear licensing terms, making it unclear whether the code can be included in a GPL'd project.

I doubt we can offer a partial hosting (only code that is not impacted by the original license), because your project core is a enhanced version of the original software.


So right now we can either be patient and wait for a thorough licensing check, or stop the approval process.

You can leave the copyright notices intact, and put them directly under the GPL header. The link you give me doesn't have GPL notices in it, so if you wish to post it, I'll review it and we can finally get your project approved :-).

While you updated the license, you didn't update the file notices:

In order to release your project properly and unambiguously under the GNU GPL, please place copyright notices and permission-to-copy statements at the beginning of every copyrightable file, usually any file more than 10 lines long.

it may be a good idea to go for an example.

After some hectic Googling, finally I found W3C SOFTWARE NOTICE AND LICENSE of World Wide Web Consortium, (Massachusetts Institute of Technology, Institut National de Recherche en Informatique et en Automatique, Keio University).

This has same wordings as the license of Brill's Tagger,
including the sentence "Title to copyright in this software..."

Importantly, the page clearly says ...
 
   "This formulation of W3C's notice and license became active on August 14 1998 so as to improve compatibility with GPL. This version ensures that W3C software licensing terms are no more restrictive than GPL and consequently W3C software may be distributed in GPL packages."

Now if you agree with this then I will change the current
mixed-up license of GPoSTTL to entirely GPL.

I understand that, unless a copyright holders puts their work into the public domain, the creator still has a copyright on their work to use as they wish. The problem stems from this:

What this essentially means is any work based off Eric Brill's tagger has its copyright held by M.I.T. That is non-free, and GPL incompatiable. It also means that the copyright of your work, regardless of the fact that its licensed under the GPL is being held by M.I.T. under this clause.

I guess there is a confusion here.  Every bit for GPL-ed free software too has some copyright holder. In most cases they
are the authors of the relevant codes. So just becuase "M.I.T" is the copyright holder in this case, does not make it "non-free".

A software is decided as "free" or "non-free" depending
on the clauses in the license and NOT by who has the
copyright for the software.

After reading beuc's comments and talking with ams on #savannah, I agree; I was mistaken in believing that was a GPL violation. However, during reviewing the license with ams, we noticed the following clause:

I went through the issue of "old BSD"-style license

According to this page the problem is "the obnoxious BSD advertising clause". It said that every advertisement
mentioning the software must include a particular sentence:

      3. All advertising materials mentioning features or
         use of this software must display the following
         acknowledgement: This product includes software
         developed by the University of California,
         Berkeley and its contributors.

On the other hand Eric Brill's license says that ...

        The name of the Massachusetts Institute of Technology
        or M.I.T. may NOT be used in advertising or publicity
        pertaining to distribution of the software. Title to
        copyright in this software and any associated
        documentation shall at all times remain with M.I.T.,
        and USER agrees to preserve same.


It seems to me Eric Brill's advertising clause is just
the opposite of "old BSD" license!

Or am I missing the issue of "advertising clause"?

I'm unfortunately at work so I can't go through the project to check headers and such, but I can respond to your licensing question.

As it stands 'old BSD'-style licenses are incompatiable with the GPL due to what's know as the adversing clause. The problem section with Brill's license is specially: "provided that you agree to comply with the following copyright notice and statements, including the disclaimer, and that the same appear on ALL copies of the software and documentation, including modifications that you make for internal use or for distribution: ".

The GPL doesn't have any restrictions on having the notices in documentation, thus (to my knowledge) is incompatiable (for reference sake, here's the revelant sections of the GPL):

6. Each time you redistribute the Program (or any work based on the Program), the recipient automatically receives a license from the original licensor to copy, distribute or modify the Program subject to these terms and conditions. You may not impose any further restrictions on the recipients' exercise of the rights granted herein. You are not responsible for enforcing compliance by third parties to this License.

In addition, under clause 6 of the GPL, you can't mix your GPL code with this license; I hate to be the bearer of bad news but any code linked against a GPL project must be GPL compatiable. Your best bet would be to try and contact Eric Brill and/or MIT (whoever holds the copyright this case), and ask them to either give you an expection to that clause, or better yet, get them to re-release under the GPL, or another GPL-compatiable license.

As it stands, I can't approve your project for hosting on Savannah until this issue is resolved. If you are going to try and contact Eric Brill on re-licensing his module, I can mark this item as Postponed, and close it until you get back to me. Otherwise, I will cancel your hosting request. If your interested in resolving your licensing issues off Savannah, you can contact via email (its in my public profile), and I'd be happy to help you.

Frankly, I have been confused with the license issue since the
beginning. So its better that I ask you for some clarifications.

GPoSTTL is based on Brill's tagger. I have added Lemmatizer
and Tokenizer parts to it and modified the original code
as needed. Now my question: am I allowed to release GPoSTTL
under fully GNU GPL as it also contains Brill's code?
I have put up the original copyright notices inside the
original source files. 

If I am allowed then I would happily change the license
to make it fully GNU GPL.

The license for Eric Bell's code qualifies your software as free software but it is incompatible with the GNU GPL (it is equivelent to the 'old BSD' style license)

We only host software published under licenses compatible with the GPL, which allows developers to combine files from any project without fear of a licensing problem.

If you are willing to switch to a GPL-compatible license, please resubmit the project.

It is based on LPost package by Jimmy Lin (jimmylin at umd.edu). LPost itself is based on Benjamin Han's ePost package, which is a cleaned-up version of Eric Brill's original code. The primary lemma list was taken from e_lemma.txt (Ver.1), complied by Prof. Yasumasa Someya (someya at someya-net.com), with permission. Later it has been and being enhanced by hundreds of additional entries.

Motivations:

    * GPoSTTL has been developed as a free software alternative for TreeTagger [1], a non-free Penn Treebank tagger developed by Prof. Helmut Schmid. GPoSTTL can be used as a drop-in substitute for TreeTagger.

As an explicit case, GPoSTTL is used as a crucial component of Anubadok[2], a GPL'ed machine translator for English to Bengali.


The default mode of GPoSTTL uses enhanced Penn tagset to make its output compatible with the output of TreeTagger. In particular, second letter of the verb tags distinguishes between "be" verbs (B), "have" verbs (H) and other verbs (V). The enhancement is done at last step of tagging procedure as its lexicon contains the original Penn tagset.
