After a long review and a lot's of thinking, I think that the patch is trivial. :)

Just take a look at the line 2098. removing the "!" before the file_exists solve the problem in a good way.
In fact if you execute this part of code you know that the directory never exists before, so we can safely create the .htaccess [ which could be a source for another problem, because if you use a special authentification (like LDAP) I'm not sure that the system handle this properly.

So you cann't know if the directory was properly created or not. As a colateral damage, the .htaccess will not be created in home dirs...

This is perhaps a feature, but ...
