Yes, it is fixed as shown in the changeset linked in comment #3.
It is not fixed in any currently released version of Octave, you will have to wait for the next major release of Octave 3.8.0 to get this fix, or build Octave from the development source.

Apparently newplot() has been extended to return a handle to the axes (not figure) that is created. See documentation for newplot here (http://www.mathworks.com/help/matlab/ref/newplot.html).
Accordingly, I'm marking this as a compatibility issue.

newplot by itself should not return anything, so I think you need a check on nargout.
