So the consensus here is that this is a Matlab bug that should not be reproduced in Octave?

It indeed seems related. Sorry for not noticing it beforehand.
The appropriate code here would be:

Otherwise it boils down to how to handle [[] {}]: Octave says it's {[]} while MATLAB says it's {}.

Please see the following report for some related issues.  That report might be describing the same problem, I don't know and don't have time to check in detail now.

Using dev (3.7.0+), the following returns:

octave> A=[];A=[A;{'a'}]
A =
  [1,1] = [](0x0)
  [2,1] = a

while 3.4.0 or MATLAB return:

octave> A=[];A=[A;{'a'}]
A =
  [1,1] = a
