Ok, good points. I've pushed a change that avoid referring to versions that were never released.

Don't care about me, I used this old Gnuplot version only accidentally and am not personally affected by this bug.

The choice is yours, but the argument that non-developer type users are unlikely to have 4.3 installed can be applied to both approaches. And there is also the argument that 4.4 is available. The choice seems just to be what you value more if one has 4.3 installed: a possibly erroneous behaviour of Octave (depending on the 4.3 variant) or missing functionality.

I think there are two practical approaches.

A) Modify Octave to treat 4.3 the same as 4.2.x
B) Update your gnuplot

Taking approach A will have the unfortunate effect of Octave not supporting ...

(1) Specifying the wxt figure size.
(2) No transparent patches
(3) No transparent surfaces
(4) Inability to determine which terminals are supported (no TikZ/Lua/etc support)
(5) Inability to set the font size for legends

As it is unlikely that a non-developer type will have 4.3 installed, I'm inclined to favor B. However, I also don't like the idea of a user being stuck with a non-functional Octave if he is not able to update gnuplot.

Are you able to update gnuplot? ... or might you be at the mercy of an administrator?

Yes, it was from development sources, but a snapshot (as far as I remember). There really seem to have been different snapshots with the same patch level ...

The snapshot which didn't work was gnuplot-4.3.0-2008-06-03. Snapshot gnuplot-4.3.0-2008-09-08, however, does indeed work.

Gnuplot at startup prints a line "last modified <Month> <Year>", maybe one can exploit this ...

As far as I know there are no gnuplot 4.3.x releases.

If you have gnuplot 4.3 installed, I assume you built it from the developer's sources. Correct?

I also have a 4.3.0 built from the developer's sources that does work. I assume mine was built with more recent sources than yours.

While in scripts/plot/__gnuplot_has_feature__.m Gnuplot version >= 4.3 is stated to have "variable_GPVAL_TERMINALS", this is not the case for a Gnuplot 4.3 (patchlevel 0) version lingering on my system:

Terminal type set to 'x11'
gnuplot> if (exists("GPVAL_TERMINALS")) print GPVAL_TERMINALS; else print NaN
NaN
gnuplot>

This lets _gnuplot_has_terminal_.m misbehave, thinking it can use this variable.

(Yes, I have also a newer Gnuplot installed; I accidentally used this old version.)
