Fixed in git and in patch-2.5.9-49-gdf890ca.tar.gz (ftp://alpha.gnu.org/gnu/patch).

When asked to create a backup file of a nonexisting file, patch creates an empty backup file and makes it unreadable (mode 0). It does this to distinguish empty files from nonexisting files, but these unreadable files create problems for many other applications.

It is unclear to me which applications would even make use of the empty-vs.-nonexistent distinction; patch itself certainly does not.
