When a patch references a file more than once (as may happen when two patches are concatenated), patch may override backup files which it had just created.

Possible solutions to this problem are to add an option not to override existing backup files, or to remember which backup files have been created.

The former approach requires that no conflicting backup files exist before patch is run, and that this option is consistently used. Both assumptions may not be easy to enforce in general.

The latter approach requires memory for keeping track of which backup files have been created. (device/inode numbers and, for non-POSIX filesystems without unique inode numbers, the file timestamps) are enough; the actual filenames are not required.
