This seems like a duplicate of bug #10059 which is fixed in SVN
if your outline view responds yes to -verticalMotionCanBeginDrag.

additionally horizontal motion beginning drag has become much easier to do since the release.

When dragging an outline's item, dragging is only accepted when the
dragging is done to the side. When dragging it below, the item below is selected instead of the outline view starting a drag operation. This behaviour makes dragging from outlines very hard. (I think it's the same problem for table views as well.)

I guess the problem could be solved by letting the NSOutlineView remember the item where the mouse button went down. It could then decide whether to select or drag by checking if the curser is currently over the same item where the button went down.
