So the consensus here is that this is a Matlab bug that should not be reproduced in Octave?

It indeed seems related. Sorry for not noticing it beforehand.
The appropriate code here would be:

Otherwise it boils down to how to handle [[] {}]: Octave says it's {[]} while MATLAB says it's {}.

Confirmed. This was a regression between versions 3.4.3 and 3.6.0.
