I am unable to contact the original author of the theme.
Theme works correctly now.

Actually it looks like this way to use _timeout_ was a part of original design but was somehow lost. Reintroduced and fixed. New theme.txt attached. Can you forward it to theme author? Please retest

Please fon't use services as the one you used for uploading files for bugreports. It encourages the usage of non-free version of flash and is very unstraightforward. Anyway the fault was in:
+ label
{
   id = "__timeout__"
   position = (8, 380)
   font = "edges 10"
   color = #AAA
   align = "center"
}

You can't put id _timeout_ at label, only at progress bars.
It shouldn't have crashed but it should work either. Also theme file uses old unscalable size specifications. I attach the corrected version

grub starts, the menu is shown for approximately 1 second, then the pc reboots
commenting out the theme in grub.cfg allows for normal booting.

System is a Dell Vostro 1700 running gentoo linux 2.6.33
grub is installed via modified ebuild pointing to the experimental branch instead of trunk
